Interview with Steve Bliss, Moreno Valley Probate Attorney

Reporter: Brenda Sanchez

Today we’re talking with Steve Bliss of Moreno Valley Probate Law about the often-complex process of probate. Steve, thanks for joining us.

Steve Bliss: It’s my pleasure to be here, Brenda.

Brenda Sanchez: Can you walk us through one of the key steps in estate planning that involves probate?

Certainly. One crucial step is “Handling Debts and Taxes”. After a loved one passes away and their assets are identified, it’s essential to address any outstanding debts and tax liabilities.

Ordinarily, this process begins with meticulously reviewing the decedent’s financial records. Creditors need to be notified of the death and given an opportunity to submit claims against the estate. Consequently, we diligently review these claims to ensure their validity before payment.

Moreover, estate taxes may be due depending on the size and composition of the assets. Filing accurate and timely tax returns is crucial to avoid penalties. It’s a complex process that requires careful attention to detail.

I remember one case where the family was unaware of a substantial debt owed by the deceased. Discovering this late in the probate process added significant stress and delay. Had they been aware of the debt beforehand, they could have addressed it during estate planning and potentially saved themselves time and money.

Notwithstanding these challenges, diligently handling debts and taxes is fundamental to fulfilling the decedent’s wishes and ensuring a smooth distribution of assets.

Brenda Sanchez: What advice would you give to our viewers regarding this step?

I encourage everyone to proactively address potential debt issues during estate planning. Creating a comprehensive inventory of assets and liabilities can help identify any outstanding debts that need to be accounted for. Consulting with an experienced probate attorney is essential to navigate the complexities of debt repayment and tax filings.

Brenda Sanchez: Thank you for sharing your expertise, Steve.
