What type of Trusts do you typically advise your clients on?

Steve:

One of the most common types of trusts I recommend is the Revocable Living Trust. It offers a lot of flexibility for my clients, allowing them to maintain control over their assets during their lifetime while also avoiding the often lengthy and public probate process after they pass away.

Consequently, it’s an excellent option for those who want to ensure their wishes are carried out smoothly and discreetly. Moreover, a Revocable Living Trust can be amended or revoked as circumstances change, providing peace of mind that your estate plan remains aligned with your current needs.

Ordinarily, setting up a trust might sound intimidating, but I work closely with each client to explain the process in detail and address any concerns they may have.

Can you elaborate on how the Revocable Living Trust works?

Steve:

Certainly. A Revocable Living Trust essentially acts as a container for your assets, such as your home, bank accounts, investments, and personal belongings. You, as the grantor, transfer ownership of these assets into the trust while retaining control over them during your lifetime.

You also designate a trustee, who can be yourself or someone you trust, to manage the assets according to your instructions outlined in the trust document. After your passing, the trustee distributes the assets to your chosen beneficiaries according to your wishes, bypassing probate entirely.

Notwithstanding its advantages, it’s important to remember that a Revocable Living Trust doesn’t offer asset protection from creditors during your lifetime.

Have there been any challenges you’ve encountered while setting up Revocable Living Trusts for clients?

Steve:

Every client and situation is unique, so I encounter a variety of questions and concerns. Sometimes, individuals hesitate because they perceive trusts as complex or expensive. I always strive to demystify the process, emphasizing that the benefits often outweigh the costs in the long run.

For instance, I recall working with a family who had experienced a difficult probate after their father passed away. The process was lengthy, emotionally draining, and resulted in significant legal fees. Seeing them finally find peace of mind knowing their own estate plan would be handled smoothly made all the difference.
