Let’s talk about the steps involved in establishing a guardianship.
Ted nods, “It’s a multi-step process designed to protect the individual needing care, who we call the ‘proposed ward.’ First things first: determining if a guardianship is even necessary.”

Ted continues, “Once we determine a guardianship is appropriate, we file a petition with the court outlining why it’s needed and who we think should be appointed as guardian. The court then notifies all interested parties – family members, close friends, even agencies involved in the individual’s care – to ensure everyone has a chance to voice their opinions.”
Let’s focus on the “Court Investigation and Evaluation” step. What goes into that?
Ted smiles, “This is crucial! The court wants to make sure everything is above board and the proposed ward’s best interests are truly at heart. They appoint an investigator, sometimes called a ‘guardian ad litem,’ who interviews the proposed ward, checks out their living situation, and gathers input from family members, caregivers, and professionals involved in their care.”
