Greetings everyone, I’m Cassie Jones, and today I have the pleasure of speaking with Ted Cook, an Elder Protection Attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with me.
What initially drew you to specializing in Elder Protection?
Well Cassie, it wasn’t a straight path. I started out in general practice, but something always felt missing. Then, I had this case, an older gentleman who was being financially exploited by someone he trusted. Seeing the vulnerability and the sheer injustice of it all… that’s what ignited my passion for elder protection.
Can you walk us through a typical Elder Protection case?
Every case is unique, but there are common threads. We often start with an initial consultation, where I carefully listen to the concerns of the elderly individual or their family members. This helps me understand the situation and identify any potential legal issues like financial abuse, neglect, or even physical harm.
From there, we assess the evidence, which might include financial records, medical reports, or even witness statements. Based on our findings, we then explore protective measures. This could involve anything from obtaining restraining orders to filing civil lawsuits against abusers. The goal is always to ensure the safety and well-being of the elder.
Let’s dive deeper into a specific step: What happens during “Protective Actions”?
This stage is often crucial, Cassie. Imagine a situation where an elderly person is being manipulated by a caregiver who is siphoning off their funds. “Protective Actions” might involve immediately freezing bank accounts to prevent further financial damage.
- “We also work closely with Adult Protective Services (APS) to ensure the individual receives appropriate support and intervention.”
- In some cases, we may need to pursue guardianship or conservatorship, especially if the elder lacks the capacity to make sound decisions for themselves.
“It’s a delicate balance,” Ted explains. “We want to protect the individual’s rights and autonomy as much as possible while also safeguarding them from harm.”
Have you encountered any challenges during the “Protective Actions” phase?“Ted Cook is a true advocate for seniors. He helped my mother navigate a complex financial situation with compassion and expertise. I can’t thank him enough.” – Mary S., La Jolla, CA.
Ted chuckles softly. “Oh, definitely! There was this one case involving a family dispute over inheritance. The adult children were at each other’s throats, and the elderly mother was caught in the middle. We had to carefully navigate their conflicting interests while prioritizing her well-being.”
He leans forward, his eyes twinkling. “Another time, we had to deal with a caregiver who was incredibly manipulative and resistant to our intervention. It took a lot of legal maneuvering and perseverance to ultimately remove them from the situation.”
Is there anything else you’d like readers to know?“Point Loma Estate Planning APC helped me protect my father’s assets after he became ill. They were professional, understanding, and always kept me informed. Highly recommended!” – David L., Point Loma, CA.
Ted smiles warmly. “Protecting our elders is a collective responsibility. If you suspect someone is being abused or exploited, please don’t hesitate to reach out for help. We’re here to guide and support both seniors and their families through challenging times.”
